About the App:
Gossipit allows users to exchange anonymous messages for free between individuals listed in each other’s contact list, provided the sender prefers not to be identified. Users agree to our Terms of Service (“Terms”) by installing the app, using the services, or accessing the website.
Services:
Minimum Age: Users must be at least 13 years old to use Gossipit. In some countries, the minimum age may vary. If the user is under the required age, they must have permission from their legal guardians, who must also agree to these Terms and take responsibility for the child’s actions on the app.
Account Creation: To create an account, users must provide their mobile phone number. They also agree to receive both anonymous and identified messages, depending on the sender’s choice, and messages from the app for account verification.
Privacy: Messages sent through Gossipit are generally anonymous, unless users choose to disclose their identity. In some features, a user’s phone number may be visible within group settings, but the identity of the sender remains private unless the user explicitly opts to reveal it. The app may collect message data for advertising purposes.
Software: Users must download updates to access new features and fixes.
Fees: Users are responsible for any costs related to using the app on their devices.
Using Gossipit
Terms and Policies: Users must follow Gossipit’s Terms and Policies when using our Services. Accounts may be suspended if the application is misused.
Legal Use: Users agree to use our Services lawfully and for their intended purpose, without violating laws, offending other users on grounds of religion, race, sexual orientation, or any other factors, and without engaging in any form of discrimination. It is prohibited to copy messages, engage in bullying, harassment, or stalking, commit fraud, record or capture the screen, distribute or sell app content, commit regional crimes, or engage in illegal activities like child abuse, selling prohibited items (guns, drugs, etc.), inciting violence, creating fake accounts, providing false phone numbers, or exploiting the Services economically in any way.
Account Security: Users are responsible for securing access to the app on their devices and for their actions within the app. If a device is lost, the user must reinstall the app on a new device using their phone number to disable access on the old one.
Emergency Services Access: The app does not provide communication with emergency services, such as the police or fire department.
Third-Party Services: Users may interact with third-party services through our platform, and must comply with the Terms and Policies of those third-party services.
Licenses and Rights Between Users and Gossipit
User Rights: Users must have the right to use the phone number registered in the app, and it must be a number that can legally identify the user if necessary.
Gossipit Rights: We own all rights related to the brand, logos, domains, patents, copyrights, intellectual property, trade secrets, and software associated with our Services. Users are prohibited from using our brand, logos, domains, patents, copyrights, intellectual property, trade secrets, and software unless they have express written permission.
Gossipit License: Gossipit grants its users a global, royalty-free, personal, limited, revocable, non-exclusive, and non-transferable license to use our Services in accordance with these terms.
Disclaimer and Limitations of Liability
Disclaimer: THE USER USES OUR SERVICES AT THEIR OWN RISK AND IS SUBJECT TO THESE TERMS AND DISCLAIMERS. WE PROVIDE OUR SERVICES “AS IS,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES. WE ARE NOT RESPONSIBLE FOR ANY FAILURES, ERRORS, DEFECTS, OPERATIONAL ISSUES, SERVICE INTERRUPTIONS, USER MISUSE, APP SECURITY ISSUES, MALFUNCTIONS, INCORRECT INFORMATION, VIRUSES, OR MALICIOUS CODE, OR ANY OTHER PROBLEMS THAT MAY ARISE. WE DO NOT CONTROL OR TAKE RESPONSIBILITY FOR USERS’ USE OF THE APP, THEIR ACTIONS, OR THE INFORMATION THEY SHARE. THE USER RELEASES US, INCLUDING OUR EMPLOYEES, PARTNERS, OFFICERS, DIRECTORS, DEVELOPERS, AGENTS, AND ANYONE INVOLVED WITH THE ADMINISTRATION OF THE APP, FROM ANY CLAIMS, LEGAL ACTIONS, DISPUTES, DAMAGES ARISING FROM THE USE OF THE APP, INCLUDING CONTENT FROM OTHER USERS, OR ANY OTHER MATTERS RELATED TO THE USE OF THE APP.
Limitation of Liability: THE USER AGREES THAT THE GOSSIPIT PARTIES WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE INCURRED BY THE USER WHILE USING OR DUE TO THE USE OF THE APP. NO PUNITIVE, INCIDENTAL, DIRECT, OR INDIRECT DAMAGES WILL BE ATTRIBUTABLE TO THE USE OF THE APP. THE GOSSIPIT PARTIES WILL NOT BE LIABLE FOR LOST PROFITS OR ANY CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATED TO, ARISING OUT OF, OR IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES, EVEN IF THE GOSSIPIT PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATE OR JURISDICTION LAWS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO THE USER. NONETHELESS, IN SUCH SITUATIONS, THE GOSSIPIT PARTIES’ LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
Availability of Our Services: Our Services may be interrupted at any time due to updates, maintenance, network services, or equipment failures, or for any other reason. We may discontinue some or all of our services, including support for certain devices and/or platforms, at any time.
Dispute Resolution and Termination of Terms
Dispute Resolution: The User agrees to resolve any claim they have with us, related to or arising from our Terms, services, or our company, exclusively in the federal or state courts of Miami-Dade County, Florida, USA. The User also agrees to submit to the jurisdiction of these courts for the purpose of litigating any disputes. U.S. law governs our Terms, as well as any disputes, whether in court or arbitration, between Gossipit and the User, regardless of conflicts of law provisions.
Termination of Terms: You may terminate these Terms with Gossipit at any time by deleting the Gossipit app from your devices and ceasing to use our Services. We may modify, suspend, or terminate your access to our Services at any time, for any reason, if you violate our Terms or create risks, damage, or potential legal exposure for Gossipit. The following provisions will survive the termination of your relationship with Gossipit: “Licenses,” “Disclaimers,” “Limitation of Liability,” “Dispute Resolution,” “Availability,” “Termination of Terms,” and “General.”
General: Gossipit may update the Terms from time to time. When we update the Terms, we will revise the “Last Modified” date associated with the updated Terms. Your continued use of our Services confirms your acceptance of the updated Terms and replaces any prior Terms. You will comply with all applicable export control laws, human trafficking regulations, and trade sanctions. The User must respect the rights of third parties, including privacy and intellectual property rights. Our Terms constitute the entire agreement between the User and Gossipit regarding our Services. If you do not agree to our Terms, you must stop using our Services.
If we fail to enforce any of our Terms, this does not mean we waive the right to enforce them. If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision will be severable from our Terms and will not affect the enforceability of the remaining provisions. Our Services are not intended for distribution or use in any country where such distribution or use would violate local law or subject us to any foreign regulations.
